Questions & Answers Regarding Photo Enforcement Speed  Citations

Q: Why Did I Get This Citation?

A vehicle, registered or leased to you, was photographed by an automatic camera connected to a speed monitoring camera.  
Vehicles traveling at a speed greater than 12 miles per hour above the posted limit are detected automatically and two
photographs are taken.  Superimposed on each photograph is the date, time, location and speed when the  violation occurred.  

Q: Is This Citation a "Traffic Ticket"?

No. This citation is not considered a "moving violation." It is a civil citation holding the registered owner or lessee responsible
for the violation (similar to a parking ticket). NO POINTS ARE ASSESSED FOR PHOTO ENFORCEMENT  SPEED VIOLATIONS
AND IT WILL NOT RAISE YOUR INSURANCE RATES!

Q: Can I Contest This Violation?

Yes.  You may request to appear in District Court by completing the request a Court Date form.. The request for trial form
should be signed and mailed to: Town of Morningside Automated Speed Enforcement, PO Box 5046, Hagerstown, MD
21741-5046, at least five days prior to the “Due Date” shown on the front of your citation.  You will be notified by mail of the
court date.  

Q: What if I was not driving the vehicle at the time of the violation?

If you, as the registered owner, were not operating the vehicle at the time of violation, you must provide a sworn statement
mailed by certified mail, return receipt request.  Your statement must swear or affirm that you were not  operating the vehicle
and shall include any other corroborating evidence, such as the name, address and, if possible, the drivers license number of the
person who was operating the vehicle.  All statements must include the citation number and be received no later than thirty (30)  
days after the mail date of the citation.  Send your statement with the included stub to:  Town of Morningside Automated Speed
Enforcement, PO Box 5046, Hagerstown, MD 21741-5046.  

Q: My vehicle or registration plate were stolen prior to the violation date?

Send a copy of the police report regarding the stolen vehicle or registration plates with the stub included in your violation notice
to: Town of Morningside Automated Speed Enforcement, PO Box 5046, Hagerstown, MD 21741-5046.  

Q: What if I fail to pay the citation?

Failure to pay the penalty shown, or to contest liability is an admission of liability and may result in the refusal or suspension of
the motor vehicle registration.  If the citation is not paid by the due date you will be liable for the a $30.00 late fee to the Town.

Q: How can I remit payment for the violation?

Payment is admission of liability.  You may pay the fine by the following methods:

    1.  By mail to Morningside Police Department; Automated Speed Enforcement; PO Box 5046; Hagerstown,  MD 21741.  Money
          orders and cashiers checks are accepted in the exact amount.  NO CASH

    2.  By web at www.ategwebpay.com. Visa, Mastercard and Discover card accepted.
    
    3.  By phone at 1-443-749-8836.  Follow the prompts and  please have your citation number as well as your credit card ready.    

Remember to write the citation number and vehicle tag number on the front of your payment and all other documentation related
to your violation.
