Brooklyn Doctor Pleads Guilty To $30M Medicaid And Medicare Fraud

Acting U.S. Attorney Joon H. Kim announced Tuesday a Brooklyn physician and four others pleaded guilty to participating in a scheme to defraud Medicaid and Medicare.

Forty-four-year-old Dr. Mustaky U. Vaid, 54-year-old Marina Burman, 49-year-old Asher Oleg Kataev, aka “Oleg Kataev,” 47-year-old Alla Tsirlin and 37-year-old Ivan Voychak conspired to defraud Medicaid and Medicare of $30 million.

PrisonAll defendants and their co-defendants paid cash kickbacks to elderly patients who were insured by Medicaid and/or Medicare and billed for unnecessary medical tests, supplies and services, according to court documents.

Aleksandr Burman who does not have a medical license established eight medical clinics, operating between 2007 and 2013 in Brooklyn. Since New York State law requires only medical professionals to own and operate medical clinics, Aleksandr Burman hired a physician as the nominal owner of each of his eight clinics. Vaid who was only hired to pose as the owner of one of the clinics fraudulently signed medical charts stating he had examined, provided referrals for unnecessary medical supplies and provided prescriptions to elderly patients.

Marina Burman, former husband of Aleksandr Burman, was previously sentenced to 10 years in prison. Marina Burman was the president and owner of Universal Supply Depot. She fraudulent billed Medicaid over $3 million for medical equipment, mostly adult diapers that were never dispensed. She also helped patients exchange their diaper prescriptions for merchandise, such as dishes, tablecloths, appliances and bed linen.

Tsirlin and Kataev – who are siblings – bribed patients and caused fraudulent bills to be submitted to Medicaid and Medicare.
